{"id":221038,"date":"2025-08-06T16:58:34","date_gmt":"2025-08-06T14:58:34","guid":{"rendered":"https:\/\/monticellospa.it\/?page_id=221038"},"modified":"2026-08-12T14:23:46","modified_gmt":"2026-08-12T12:23:46","slug":"conditions-of-sale","status":"publish","type":"page","link":"https:\/\/monticellospa.it\/en\/conditions-of-sale\/","title":{"rendered":"Condizioni di Vendita"},"content":{"rendered":"<h1><strong>GENERAL TERMS AND CONDITIONS OF SALE<\/strong><\/h1>\n<h1><\/h1>\n<h5>Article 1 \u2013 Purpose and Scope<\/h5>\n<p>These General Terms and Conditions of Sale (hereinafter<strong>\u201cGTCS\"<\/strong>govern the purchase and use of tickets, services, and products offered by Monticello SPA S.r.l. at the centre called \u201cMonticello SPA &amp; FIT\u201d located at Via San Michele 16\/D, Loc. Cortenuova, Monticello Brianza (23876 - LC) (hereinafter the<strong>\u201cSeller\u201d<\/strong>or the<strong>\u201cFacility\u201d<\/strong>\u201d).<\/p>\n<p>Purchases can be made:<\/p>\n<ul>\n<li>through the official online shop available at <a href=\"https:\/\/monticellospa.it\/en\">https:\/\/monticellospa.it\/en\/<\/a> (hereinafter the \"<strong>Site<\/strong>\u201d);<\/li>\n<li>at the SPA reception desk (the \"<strong>Reception<\/strong>\u201d).<\/li>\n<\/ul>\n<p>Transactions are governed by Legislative Decree 6 September 2005 No. 206 (Consumer Code), Legislative Decree 9 April 2003 No. 70 (Electronic Commerce), as well as \u2013 with regard to personal data protection \u2013 by EU Regulation 2016\/679 (GDPR) and Legislative Decree No. 196\/2003 as amended.<\/p>\n<h5>Article 2 \u2013 Acceptance of the GTCS<\/h5>\n<p>By making a purchase via the Site or at the Reception, the Customer declares that they have read and fully accept these GTCS without any reservation.<\/p>\n<p>The purchase of tickets, services, and products \u2013 whether via the Site or Reception \u2013 also entails the Customer\u2019s full acceptance of the Rules containing the behavioural norms to be observed within the facility, available at\u00a0 <a href=\"https:\/\/monticellospa.it\/en\/regulation\/\">https:\/\/monticellospa.it\/en\/regulation\/<\/a><\/p>\n<p>The Seller reserves the right to modify or update these GTCS at any time. The GTCS in force at the date of purchase shall apply.<\/p>\n<h5>Article 3 \u2013 Types of Tickets and Services Available<\/h5>\n<p>The Seller offers the following types of products and services:<\/p>\n<ol>\n<li><strong>a) Fixed-date Ticket<\/strong><\/li>\n<\/ol>\n<p>A product that allows <strong>access to the Day SPA on a specific date<\/strong>, possibly including treatments, massages, or wellness paths indicated on the Site.<\/p>\n<p>Included services must be used on the selected date.<\/p>\n<ol>\n<li><strong>b) Gift Voucher<\/strong><\/li>\n<\/ol>\n<p>A gift voucher that allows access to the Day SPA and\/or specific wellness services offered by the Facility.<\/p>\n<p>The date of use must be <strong>booked later<\/strong> via the Site or by contacting the Reception <strong>at least 7 days in advance <\/strong>to the intended date of use.<\/p>\n<p>Il Gift Voucher, una volta emesso, entra nella disponibilit\u00e0 esclusiva del Beneficiario indicato dall&#8217;Acquirente, quale documento di legittimazione ai sensi dell&#8217;art. 2002 c.c. Il Beneficiario potr\u00e0 decidere se, quando e come utilizzarlo, nel rispetto dei termini di validit\u00e0 previsti dalle presenti CGV. La Struttura non pu\u00f2 fornire all&#8217;Acquirente informazioni sul suo utilizzo, stato o data di fruizione, trattandosi di dati personali di un soggetto terzo che il Venditore tratta, ai sensi dell&#8217;art. 5 del GDPR, nei soli limiti necessari all&#8217;erogazione del servizio.<\/p>\n<ol>\n<li><strong>c) Monetary Gift Card <\/strong><\/li>\n<\/ol>\n<p>A voucher of monetary value available in different amounts, usable to purchase Day SPA entries or services until the credit is exhausted.<\/p>\n<p>The Monetary Gift Card can be used in multiple transactions until the credit is fully used.<\/p>\n<ol>\n<li><strong>d) Multiday Pass<\/strong><\/li>\n<\/ol>\n<p>A package composed of multiple Day SPA entries, usable progressively, subject to booking via the Site or by contacting the Reception.<\/p>\n<h5>Article 4 \u2013 Issuance of the Purchase Document<\/h5>\n<p>Following the purchase of tickets, services, or products offered by the Seller as described in Article 3, the Customer will receive a digital or paper identification document (hereinafter the<strong>\u201cPurchase Document\u201d<\/strong>or \u201cDocument\u201d).<\/p>\n<p>The Purchase Document:<\/p>\n<ul>\n<li>is identified by a unique alphanumeric code;<\/li>\n<li>constitutes the entitlement to access the purchased services;<\/li>\n<li>must be presented when using the services at the facility.<\/li>\n<\/ul>\n<h5>Article 5 \u2013 Obligations of the Customer<\/h5>\n<p>The Customer is required to read these GTCS before making a purchase.<\/p>\n<p>Making a purchase via the Site or at the Reception implies full knowledge and acceptance of these GTCS.<\/p>\n<p>The Customer also undertakes to:<\/p>\n<ul>\n<li>provide accurate and up-to-date personal data;<\/li>\n<li>carefully keep the received Purchase Document;<\/li>\n<li>comply with the Facility Rules.<\/li>\n<\/ul>\n<p>The Customer is responsible for <strong>safeguarding the identification code of the Purchase Document<\/strong>, which is necessary to access the purchased services.<\/p>\n<h5>Article 6 \u2013 Conclusion of the Contract<\/h5>\n<p>All prices indicated on the Site or at the Reception are expressed in Euro and include VAT, unless otherwise stated.<\/p>\n<p>The contract is considered concluded and legally binding when:<\/p>\n<ul>\n<li>the Customer has made full payment of the price of the selected service or product;<\/li>\n<li>the Seller has issued the corresponding Purchase Document.<\/li>\n<\/ul>\n<p>For purchases made via the Site, the Document will be sent to the email address provided by the Customer during registration or purchase. For purchases made at the Reception, the Purchase Document will be delivered directly to the Customer in digital or paper format.<\/p>\n<p>Any errors in the data provided by the Customer must be reported promptly by contacting the Reception using the contacts indicated on the Site.<\/p>\n<h5>Article 7 \u2013 Validity and Use of the Purchase Documents<\/h5>\n<p>Except in the case of a fixed-date Ticket, the issuance of the Purchase Document does not automatically constitute a reservation of the service.<\/p>\n<p>Reservations must be made by contacting the facility via email or through the Site.<\/p>\n<p>On the day of the reservation, the Customer must present the Purchase Document at the Reception.<\/p>\n<p>Unless otherwise indicated, the Purchase Document <strong>is valid until the expiry date shown on it.<\/strong>After this date, <strong>the Purchase Document will automatically expire, without any refund<\/strong>.<\/p>\n<p>If the Purchase Document includes multiple services, these must be used on the same day, unless otherwise indicated.<\/p>\n<h5>Article 8 \u2013 Temporarily Unavailable Services<\/h5>\n<p>The Facility reserves the right to modify or temporarily suspend certain services due to:<\/p>\n<ul>\n<li>technical or maintenance requirements;<\/li>\n<li>organizational reasons;<\/li>\n<li>extraordinary events or Force Majeure, as defined in Article 9 below.<\/li>\n<\/ul>\n<p>If one or more services included in the Purchase Document are temporarily unavailable, the Customer may:<\/p>\n<ul>\n<li>use alternative services of equal value;<\/li>\n<li>obtain an extension of the validity of the Purchase Document limited to the period of unavailability.<\/li>\n<\/ul>\n<p>Per usufruire dei servizi in una data successiva, il Cliente dovr\u00e0 richiedere la modifica della prenotazione inviando una comunicazione all&#8217;indirizzo e-mail <strong><a href=\"mailto:info@monticellospa.it\">info@monticellospa.it<\/a><\/strong>. Non \u00e8 previsto alcun ulteriore indennizzo o rimborso.<\/p>\n<h5>Article 9 \u2013 Force Majeure<\/h5>\n<p>Force majeure refers to all extraordinary, unforeseeable, and unavoidable events, not attributable to the Seller and not preventable with ordinary diligence, that prevent or temporarily make it impossible, in whole or in part, to provide the services offered by the Facility.<\/p>\n<p>Exemplary and non-exhaustive cases of force majeure include:<\/p>\n<ul>\n<li>natural disasters (such as earthquakes, floods, landslides, or exceptional weather events);<\/li>\n<li>fires, explosions, or significant technical faults in the facility\u2019s systems;<\/li>\n<li>prolonged interruptions of electricity, water, or other essential services;<\/li>\n<li>epidemics, pandemics, or health emergencies;<\/li>\n<li>measures by public authorities limiting or preventing access to the facility or the provision of services;<\/li>\n<li>strikes, industrial action, or other circumstances beyond the Seller\u2019s control.<\/li>\n<\/ul>\n<p>In the event of force majeure, the Seller cannot be held responsible for the impossibility of providing the purchased services.<\/p>\n<p>In such cases, the Customer is entitled, at the Seller\u2019s discretion, to:<\/p>\n<ul>\n<li>use the purchased services on a later date, subject to the Facility\u2019s availability; or<\/li>\n<li>obtain an extension of the validity of the Purchase Document limited to the period of unavailability.<\/li>\n<\/ul>\n<p>La richiesta di modifica della prenotazione dovr\u00e0 essere effettuata mediante comunicazione all&#8217;indirizzo e-mail <a href=\"mailto:info@monticellospa.it\"><strong>info@monticellospa.it<\/strong><\/a>. Resta escluso il diritto del Cliente a qualsiasi ulteriore indennizzo, rimborso o risarcimento<strong>.<\/strong><\/p>\n<h5>Article 10 \u2013 Loss or Theft of the Purchase Document<\/h5>\n<p>The Seller is not responsible for any <strong>loss, theft, or misuse of the Purchase Document.<\/strong>.<\/p>\n<h5>Article 11 \u2013 Changes to the Reservation<\/h5>\n<p>La gestione della prenotazione (modifica della data e\/o dell&#8217;orario) potr\u00e0 essere effettuata online, tramite l&#8217;apposita sezione del Sito disponibile al seguente link: <strong><a href=\"https:\/\/monticellospa.it\/en\/info-per-la-tua-esperienza\/\">Info per la tua esperienza<\/a><\/strong>, entro e non oltre le 24 (ventiquattro) ore precedenti l&#8217;orario della prenotazione.<\/p>\n<p>La data della prenotazione potr\u00e0 essere modificata un numero illimitato di volte, purch\u00e9 nel rispetto del suddetto termine di preavviso e comunque entro il periodo di validit\u00e0 del Titolo di Acquisto.<\/p>\n<p>In caso di comunicazione tardiva, ovvero effettuata oltre il termine sopra indicato, o di mancata presentazione (no-show), il Titolo di Acquisto sar\u00e0 considerato utilizzato.<\/p>\n<h5>Article 12 \u2013 Right of Withdrawal<\/h5>\n<p>Pursuant to Art. 52 of the Consumer Code, the Customer who has purchased via the Site has the right to withdraw from the contract <strong>within 14 days of the purchase date<\/strong>provided the Purchase Document has not been used.<\/p>\n<p>The right of withdrawal does not apply to fixed-date Tickets as they fall under leisure activities with a specific date or period, pursuant to Art. 59 letter n) of the Consumer Code.<\/p>\n<p>The withdrawal request may be sent via:<\/p>\n<p>PEC: <a href=\"mailto:monticellospa@pec.it\">monticellospa@pec.it<\/a><\/p>\n<p>Registered Mail: Monticello SPA S.r.l., Via San Michele 16\/D, Loc. Cortenuova, Monticello Brianza (23876 - LC)<\/p>\n<p>If the withdrawal is valid, the amount will be refunded <strong>within 14 days<\/strong> of receiving the communication.<\/p>\n<h5>Article 13 \u2013 Complaints and Assistance<\/h5>\n<p>For information or reports, you can write to:<\/p>\n<p>&#8211; E-mail: info@monticellospa.it<\/p>\n<h5>Article 14 \u2013 Applicable Law and Jurisdiction<\/h5>\n<p>The GTCS are governed by Italian law.<\/p>\n<p>For any disputes, the competent court is that of the Customer\u2019s residence or domicile if located in Italy. Otherwise, the Court of Lecco shall have jurisdiction.<\/p>\n<h5>Article 15 \u2013 Final Clauses<\/h5>\n<p>Pursuant to and for the purposes of Articles 1341 and 1342 of the Civil Code, the Customer expressly approves the following clauses:<\/p>\n<p>Art. 7 (Validity and Use of the Purchase Documents) - Art. 8 (Temporarily Unavailable Services) - Art. 9 (Force Majeure) - Art. 10 (Loss or Theft of
